Article 1 – Definitions
In these terms and conditions the following terms shall have the following meanings:
– Seller: The company that offers plants.
– Customer: Any natural person or legal entity who enters into an agreement with the seller.
– Product: Hedera hedges and hydrangeas.
– Distance selling: an agreement whereby exclusive use is made of one or more distance communication techniques, such as internet sales.
Article 2 – Applicability
These terms and conditions apply to all offers, quotations, orders and deliveries of products by the seller, unless otherwise agreed in writing.
Article 3 – Offer and Agreement
All offers are without obligation and subject to availability.
The agreement is concluded once the customer places an order through the website and receives confirmation by email. The seller thereby confirms receipt of the order and the conclusion of the distance contract.
Article 4 – Prices and Payment
All prices include VAT and exclude shipping costs, unless otherwise stated.
Payment must be made within 14 days of invoice date, unless otherwise agreed.
Article 5 – Delivery
Delivery will take place at the agreed address.
Delivery time is usually 3 to 5 working days, depending on availability and season.
Delay in delivery does not entitle you to compensation.
Article 6 – Right of withdrawal
Private customers have the right to cancel the contract within 14 days after receiving the product without giving any reason.
During this cooling-off period, the customer must handle the product and packaging with care.
If the customer exercises the right of withdrawal, he must return the product within 14 days of notification of withdrawal.
Return shipping costs are the responsibility of the customer, unless otherwise agreed.
Products that spoil or age quickly (such as live plants) are excluded from the right of withdrawal, unless the plants do not comply with the agreement upon delivery.
Article 7 – Warranty and Liability
The seller guarantees that the delivered plants are healthy and in accordance with specifications.
The warranty is void in case of improper use, poor care or damage by third parties.
Liability is limited to the invoice amount of the product in question.
Article 8 – Complaints
Complaints must be reported in writing within 48 hours of delivery.
The seller will respond to the complaint within 5 working days.
Article 9 – Force Majeure
In the event of force majeure (such as extreme weather conditions, crop disease, transport problems), delivery may be postponed or cancelled without compensation.
Article 10 – Privacy
Personal data will only be used for the execution of the agreement and will not be shared with third parties without permission.
Article 11 – Images and Product Display
The images and product photos on the website are for illustrative purposes only. Because these are live plants, the color, density, and growth stage may vary from the images shown.
The ready-made ivy hedges are delivered fresh and are generally at least 80% dense upon delivery. Complete leaf coverage can take one growing season, depending on location and care.
Article 12 – Retention of title
The delivered products remain the property of the seller until full payment has been made by the customer.
Article 13 – Disclaimer for product descriptions and prices
The seller strives to display products and prices as accurately as possible. Errors in product descriptions, images, or prices are subject to change and do not entitle you to compensation.
Article 14 – Liability during transport
The seller is not liable for damage incurred during transport, unless otherwise agreed. Complaints about transport damage must be reported within 24 hours of delivery.
Article 15 – Dispute resolution
These terms and conditions are governed by Dutch law. Disputes will preferably be resolved through consultation. If necessary, the dispute will be submitted to the competent court in the seller's district.
Article 16 – Changes to terms and conditions
The seller reserves the right to amend these terms and conditions. The amended terms and conditions will apply from the moment they are published on the website.
